4MyFans, available at 4myfans.ch, that will be further addressed as the "Website", is a social platform that allows Users to upload on their profile, photos and videos, setting a monthly fee per subscription in order to earn money from paying subscribers, referred to as "Fans". 4MyFans is operated by Halosauridae Ltd.

By registering and using 4MyFans, you accept and agree to be bound by and abide by our Terms of Service and Privacy Policy. If you do not want this to happen, you must not access or use this Website.

This Website is available for Users who are 18 years of age or older. By agreeing to use this Website, you warrant that you are of legal age to form a binding contract with us, and meet our eligibility requirements.

We reserve the right to change at any time, these Terms. All the changes will be effective as soon as we post them. Please check from time to time the Terms of Service, in order to be up to date with the latest changes.

When agreeing to use 4MyFans, you also agree to receive from us emails, messages to your 4MyFans account. If you wish to withdraw our consent to receive such communications from us, please put that in writing at our available email address, provided at the contact page.

We do not have anything to do with the User Content, and with any views that might be expressed by the Users of our website. We distance ourselves from our Users' views because they do not necessarily represent the views of 4MyFans.

We do not interfere into the interactions or transactions between the 4MyFans Users.

4MyFans reserves the right at any time and without notice, to:

1. Modify, suspend or terminate 4MyFans or a segment of this product.
2. Restrict, limit, suspend or terminate your access to 4MyFans.ch or at a section of it.
3. Delete any content that you post on 4MyFans.ch, that does not comply with these Terms of Service, or in respect of which we suspect that there may be an infringement of rights or legal provisions.
4. Monitor your use of 4MyFans, in order to verify compliance with these Terms of Service.
5. Investigate any cases of misuse or unlawful use of 4MyFans & cooperate with law enforcement officers when needed.
6. Disclose information regarding your use of 4MyFans, as part of a law enforcement investigation regarding alleged illegal activity, or as a response to a court order.
7. Change the payment or payout processor that helps you make/receive payments as a 4MyFans User.
8. From time to time, some parts of the Website, or even the entire Website may be restricted to Users.

When on 4MyFans.ch, you as a User, can create a profile and: upload photos and videos, directed to Fans, and subscribe to another User's profile, to see their photos and videos, otherwise restricted.

The creator of the profile, where photos and videos are uploaded, are referred to as "Users", the media that a User uploads on his profile is referred to as "User Content".

1. Registering an Account
   1. Create an account on 4MyFans.ch, by providing a valid email address, username, password.
   2. When creating an account on 4MyFans.ch, you agree that all the information provided is governed by our Privacy Policy and Terms of Service, and you consent to all actions we take.
   3. When subscribing to other profiles you need to add a payment card. The card information is then stored by a payment processor. 4MyFans reserves the right to change the payment processor it uses at any time, without noticing the Users. 4MyFans does not store any payment card info.
   4. If you are looking to make money from the Users subscribing to your profile, add a bank account and upload a valid form of ID. Your earnings will be paid into your bank account, via one of our payout processors or via direct bank wire.
   5. When registering on 4MyFans.ch, you confirm that:
      • your account info, profile info and content provided is your own.
      • if you've had a previous account on our website, that old account was not suspended for violation of our Terms of Service.
      • you will not use a third-party payment processor to accept payments for subscriptions.
      • You will not sell, license, rent or transfer your account to any third party, and you do not grant any third party a right to use it.
      • We reserve the right to verify the info that you provide to us, and the compliance with our Terms of Service.
   6. You are fully responsible for the activities that occur on your account. You are also responsible for keeping your login details confidential and secure. Contact us if you believe someone is using your account without your permission or if you encounter a breach of security. Be extra careful when accessing your account from a public or shared computer.
   7. 4MyFans.ch has the right to disable any user name, password, at any time and at our sole discretion, including if in our opinion you have violated the Terms of Service.
2. Subscriptions, Purchases and Payments

   Add a payment card, in order to access another User's content on 4MyFans.ch. After that click the "Subscribe" button on that User's profile. The purchases you make are final and non-refundable.

   You may cancel the subscription at any time. All you have to do is turn off the Auto-Renew button in your User profile, or by directly contacting us.

3. Refunds

   As mentioned before, all purchases made on 4MyFans.ch are final and non-refundable. You can cancel any subscription at any time given and for any reason. A purchase made on our Website, that results in a chargeback will cause the User's account to be immediately excluded from our website. The chargeback will be removed from the earning of the Creator's income.

4. Deactivation

   If you want to deactivate your 4MyFans.ch account, contact our support team and submit your deactivation request. Your account will be deactivated within 10 working days after receiving the request.

5. Intellectual Property Rights

   Except for the User Content, all the contents, features and functionalities of the Website are owned by Halosauridae Ltd and are protected by national and international copyright, trademark, patent, trade secret and proprietary rights laws. We are talking about information, software, text, display, images, video, audio, design and so on.

   Do not: reproduce, distribute, modify, create derivative work of, republish, publicly display/perform, download, store or transmit any of the materials existing on the Website. If you do print, modify, copy, download and provide another person with access to the Website, breaching the Terms of Service, your right of using the Website will stop immediately.

   You cannot use any marks connected to 4MyFans or our affiliates, like logos, services, names and so on.

6. Do not use 4MyFans:
   • To impersonate one of our employees or representatives, another User or another entity
   • Falsify account registration information
   • In any manner or purpose that is illegal or unlawful, including violating another person's rights.
   • To depict a minor in a suggestive or exploiting way.
   • To copy, reproduce, distribute or modify derivative works from.

   Do not create Content that:

   • is obscene, illegal, fraudulent, defamatory, libelous, hateful, discriminatory, threatening or harassing.
   • violates another's copyright, trademark, right of privacy, right of publicity, or other property or personal right.
   • promotes or advertises escort services, firearms, other weapons or drugs.
   • promotes any illegal activity.
   • causes annoyance, inconvenience, or needless anxiety to other persons.
   • involves commercial activities or sales, such as contests, sweepstakes and other sales promotions, barter, or advertising.

   Do not :

   • act in an abusive manner towards any other User or employee, agent or representative of the Website.
   • remove, erase, modify or tamper with any copyright, trademark or other proprietary that you do not own.
   • interfere in any way with the operation of 4MyFans or any server, network or system associated with 4MyFans, including, without limitation: hacking, mail-bombing, flooding, overloading, or making "denial of service" attacks; probing, scanning or testing the vulnerability of the app or any server, network or system associated with the app; breaching or circumventing firewall, encryption, security or authentication routines; accessing information not intended for you, or accessing another User's account that you are not expressly authorized to access.

7. Warranties

   4MyFans does not warrant that the use of the Website will be uninterrupted or error free 24/7. We may need to carry maintenance programs from time to time. In general, the services are provided on an "as is" and "as available" basis. 4MyFans expressly disclaims all warranties of any kind, whether express or implied, including, without limitation, the implied warranties of merchantability, fitness for a particular purpose, quality and non-infringement, to the maximum extent provided by law.

   In particular, 4MyFans shall not be liable under contract, tort, negligence, liability, for any indirect, incidental, exemplary, special, punitive or consequential damages arising out of or related to your use of 4MyFans or any of its services or features.

   By creating a 4MyFans account you warrant that:

   • you are 18 years of age
   • you will comply with the Terms of Service
   • you take responsibility for the use of 4MyFans on any device
   • you take responsibility for the User Content created or provided by you
   • you won't violate any applicable law

8. Liabilities

   Halosauridae Ltd will not be liable to you for any of the following:

   • Errors, mistakes, or inaccuracies of content.
   • Content or conduct that is infringing, inaccurate, obscene, indecent, offensive, threatening, harassing, defamatory, libelous, abusive, invasive of privacy, or illegal.
   • Unauthorized access to or use of the Company's servers and any personal or financial information stored in them, including unauthorized access or changes to your submissions, transmissions, or data.
   • Bugs, viruses, Trojan horses, malware, or other disabling code that may be transmitted to or through the Website by any person or that might infect your computer or affect your access to or use of the Website, your other services, hardware, or software.
   • Incompatibility between the Website and your other services, hardware, or software.

   For avoidance of doubt, to the extent an indemnification or release is provided in favor of or for the benefit of Halosauridae Ltd, such indemnification or release shall extend to its agents, affiliates, employees, officers, directors, shareholders, attorneys, vendors, contractors, predecessors, successors and assigns.

9. Links

   Halosauridae Ltd. has no influence on and is not responsible for the content of external websites that are accessible through links on the Website.

10. Entire Agreement

    These Terms of Service constitute the sole and entire agreement between you and us regarding the Website and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Website.

11. Applicable Law and Jurisdiction

    These Terms of Service are governed by the laws of Cyprus. The exclusive Place of jurisdiction is Nikosia.
